Business Assessment Questionnaire – Legal


    Does your business require a license?

    If so, what type of license?

    Has the business ever been under investigation or audit by a government agency?

    If so, what agency?

    If so, what were the results?

    Has the business ever been a defendant in a lawsuit?

    If so, who sued you?

    If so, what were the results?

    Does the business have liens against it?

    If so, what are they for, and in what amounts?

    Do you have Bylaws or an operating agreement for your entity?

    Do you have regular meetings of the Board of Directors & Shareholders?

    Do you document the meetings with minutes? [cradio radio-le-13 use_label_element "Yes" "No"]

    Have you ever asked for investors to fund your business?

    Do you properly shred confidential material?

    Do you destroy the memory and then properly dispose of computer/electronic parts/copiers?

    Do you have any patents, trademarks, copyrights or registered trade names?

    If so, which kind and for what?

    Have you ever received a fine from OSHA?

    Do you allow associates to do “side-work?”

    If so, do you allow associates to use company equipment and supplies on side work?

    Do your associates take equipment or vehicles home?

    Do you have a collection agent or collection attorney?

    If so, who is it?

    Do you use affidavits in your business?

    If so, do you sign affidavits which aren’t true at the time of signing?

    Do you require a down payment or deposit before starting work?

    Has your sales contract been reviewed by an attorney?

    Do you maintain a permanent file of resumes and job applications?


    Note that #1 means you strongly agree,

    #2 means you somewhat agree,

    #3 means you neither agree nor disagree,

    #4 means you somewhat disagree and

    #5 means you strongly disagree.

    If I had to comply with every single law I couldn’t survive.
